Prices are subject to change without notice. The most recent price list supersedes all previously published price lists.
Billing and Payment Terms
PMT Medical extends the following terms:
- Terms of sale are Net 30 — the balance is due 30 days from the invoice date.
- A finance charge of 2% is charged monthly on any balance outstanding 30 days past the invoice date.
- Orders are not shipped on delinquent accounts.
- PMT reserves the right to terminate open account credit at any time.
- If default of payment occurs, the customer agrees to pay any and all attorney's fees and collection costs, up to and including asset seizure.
- All new accounts are required to pay for their first 2 orders by credit card. After that, a new account may be given a minimum credit limit of $1,500.00; initial credit limits are considered after review of the credit information supplied on this application.
- Credit card orders only: single credit card transactions over $2,500.00 are assessed a 2.5% processing fee. Payment by check or wire is not subject to this fee.
- After the first 2 orders, PMT offers all accounts next tier pricing on any invoice pre-paid upon shipping. Next tier pricing means you are given the next highest quantity discount price on any item paid for when shipped, which can result in substantial savings.
- This agreement continues as long as your invoices are paid within our terms of sale.
Payment information is collected separately by phone or secure payment link and is never recorded on this application.
Shipping Arrangements
All merchandise is shipped via United Parcel Service (“UPS”) Ground unless specified otherwise. UPS charges and a handling fee are added to your bill. Shipments outside the continental United States are billed accordingly. UPS requires a deliverable street address (no P.O. boxes) with someone available to sign for the delivery if a signature is needed.
Returns — Defective, Damaged, or Incorrectly Shipped Merchandise
- Notify PMT of defective, damaged, or incorrectly shipped merchandise within 14 days of receipt.
- Request a Return Merchandise Authorization (RMA) number from PMT Customer Service. The RMA number is valid for 60 days.
- All shipping charges for the returned merchandise are incurred by the customer. CODs are not accepted.
- A copy of the invoice must accompany the merchandise.
- A detailed description of the merchandise's defects, along with the proposed solution (REPLACEMENT or CREDIT), must accompany the merchandise.
- Replacement of, or credit for, the merchandise is issued after a detailed inspection and verification of the defects, as agreed upon by PMT and the manufacturer.
- The manufacturer's warranty takes first priority.
Returns — All Other Merchandise
- Notify PMT of a return within 14 days of receipt.
- Request a Return Merchandise Authorization (RMA) number from PMT Customer Service. The RMA number is valid for 60 days.
- All shipping charges for the returned merchandise are incurred by the customer. CODs are not accepted.
- A copy of the invoice must accompany the merchandise.
- Credit is issued on merchandise verified as resalable by PMT's inspection:
- Returned within 14 days of the invoice date: full credit.
- Returned after 15 days of the invoice date: full credit minus a 15% restocking / processing fee.
- Returned after 60 days of the invoice date: please call Customer Service.
Minimum Advertised Price (MAP) Policy
PMT adheres to a strict MAP policy: no product may be advertised at a suggested retail price lower than the price stated under the “MAP” heading on our official price sheet. This policy applies to all dealers and distributors, to all products, and to all online pricing. Any breach of this policy could result in account termination.
MAP applies to advertised prices only. It does not apply to the price at which MAP products are actually sold, and it does not establish a maximum advertised price — offers may be made in excess of the MAP established. MAP does not apply to the price at which a PMT product is actually sold or offered for sale to an individual consumer within the dealer's retail location.
Amazon and Marketplace Policy
Upon becoming an active account with PMT, you are approved to list and sell our products on the website under which you established your account only. PMT products cannot be listed on Amazon.com without the prior written approval of PMT. Other merchant marketplaces, such as eBay and Overstock, are permitted. Violation of this policy will result in account termination.
General Terms
Indemnification. The undersigned shall indemnify, defend and hold harmless PMT and its employees, subcontractors and agents from and against any and all liabilities, obligations, penalties, claims, judgments, demands, actions, disbursements of any kind and nature, suits, losses, damages, costs and expenses (including, without limitation, reasonable attorney's fees) arising from the undersigned's actions or inactions that relate in any way to this agreement or to transactions between PMT and the undersigned's business.
Severability. If any provision of this Agreement is held to be ineffective, unenforceable or illegal for any reason, that decision shall not affect the validity or enforcement of any or all of the remaining portions of this Agreement.
Governing law and venue. The undersigned agrees that any dispute with PMT whatsoever shall take place solely in the forum of Summit County, Ohio, and that Ohio law applies to all disputes. Should a dispute arise between the parties, and if PMT is the prevailing party, the undersigned agrees that PMT is entitled to a reasonable award of its attorney's fees incurred in prosecuting or defending the action. The undersigned agrees that this fee shifting provision inures to the benefit of PMT only. The total sum of damages shall not exceed the cost of the product that brought rise to the dispute.
Acceptance
By signing, the undersigned agrees to the terms above. I have read, understand, and agree to the Account Agreement and Terms of Sale set out in this application. I understand that these policies may change at any time and that I will be notified of such changes by US mail.
Personal Guarantee. By signing below, the undersigned individual absolutely and unconditionally guarantees personal liability for the full payment of any and all debts incurred by the applicant business, specifically including any bounced checks, dishonored credit card transactions, or failed payments issued to PMT. This personal guarantee is absolute, independent of the business's corporate status, and binds the individual signer in their personal capacity regardless of any corporate title held.
Signature requirements. Corporations require the signatures of two corporate officers. Partnerships require the signatures of two partners. Sole proprietors and single-member entities sign once.
